Court: NLRB Recess Appointments Unconstitutional *

Jan. 25, 2013 | A federal appeals court said Friday that President Obama over-stepped his authority with a series of recess appointments to the National Labor Relations Board. The case may wind up in the Supreme Court, and determine how far the president can go in appointing people whose nominations would be filibustered in the Senate…Senate Republicans had blocked Obama's appointed to the NLRB, calling them too pro-union. It's not known if the Supreme Court will step into this White House-Congress dispute. As it stands [now], the decision invalidates hundreds of decisions made over the past year by the NLRB. [The three members of the appeals court are Republican appointees.] * Update: Here's a Teamster Nation post with interesting information about this development, including a prediction that the ruling will be overturned.
